Contratos Inteligentes.

Abstract

En la postrimería del siglo XX, el "tiempo" pasó a convertirse en un "bien" preciado en sí mismo. La "velocidad" resultó ser la vía adecuada para aprovecharlo en mayor medida. Velocidad, es sinónimo de productividad, competitividad, mayor beneficio económico y disfrute. Internet y las nuevas tecnologías de la información y la comunicación (TICs) han sido el cauce para saciar tal ambiciosa meta, conjuntamente con la necesidad consolidada de la contratación en masa. Las TICs no se han conformado con acelerar el proceso de celebración del contrato, sino que yendo por más, buscaron asegurar, que la ejecución de las cláusulas contractuales se produzca casi instantáneamente. Este objetivo se logró con los denominados "contratos inteligentes" (smart contracts). Sin embargo y pese a las ventajas de semejante operatoria, la vorágine y el afán por la rapidez pueden generar situaciones injustas y peligrosas para desprevenido consumidores de bienes y servicios. El propósito de este proyecto, es desentrañar la esencia y problemática de esta novedosa modalidad de contratación.

In the late twentieth century, "time" became a precious "good". "Speed" turned out to be the right way to make the most of it. Speed is synonymous with productivity, competitiveness, greater economic benefit and enjoyment. The Internet and the new Information and Communication Technologies (ICTs) have been the channel to satisfy this goal, in conjunction with the consolidated need for mass recruitment. ICTs were not content with speeding up the process of concluding the contract, but rather, they sought to guarantee the automatically execution of contractual clauses. This objective was met by the so-called "Smart Contracts". However, despite the advantages of this trading system, the eagerness for speed can create unfair and dangerous situations for unprepared consumers of goods and services. The purpose of this project is to disentangle the essence and the problems of this method of recruitment.
