Abstract

El presente trabajo analiza la responsabilidad civil derivada de actos discriminatorios en el derecho argentino, a partir del vínculo entre igualdad, dignidad humana y reparación del daño. Examina el marco constitucional, convencional y legal aplicable, con especial atención a la Ley N° 23.592, el Código Civil y Comercial y la evolución jurisprudencial en materia de discriminación. Asimismo, aborda los presupuestos de la responsabilidad civil, las dificultades probatorias propias del litigio antidiscriminatorio y las funciones preventiva, resarcitoria y punitiva del derecho de daños. A través del estudio de casos vinculados con discriminación por sexo, discapacidad, orientación sexual, religión y condición social, se identifican criterios comunes para la atribución de responsabilidad, la reparación del daño moral y el rol judicial frente a prácticas que afectan la igualdad real de las personas.

This paper analyzes civil liability arising from discriminatory acts under Argentine law, focusing on the relationship between equality, human dignity, and compensation for harm. It examines the applicable constitutional, conventional, and statutory framework, with particular attention to Law No. 23,592, the Argentine Civil and Commercial Code, and the evolution of case law on discrimination. It also addresses the elements of civil liability, the evidentiary difficulties inherent in anti-discrimination litigation, and the preventive, compensatory, and punitive functions of tort law. Through the study of cases involving discrimination based on sex, disability, sexual orientation, religion, and social condition, the paper identifies common criteria for attributing liability, awarding compensation for non-pecuniary harm, and defining the role of the judiciary in addressing practices that affect real equality among individuals.
