Criptoactivos en el Derecho Sucesorio: herramientas jurídicas para su planificación y efectiva transmisión

Abstract

La incorporación de los criptoactivos al patrimonio de las personas plantea nuevos desafíos para el Derecho Sucesorio, especialmente en lo relativo a su transmisión mortis causa. Si bien estos activos pueden integrar el acervo hereditario, sus particulares características tecnológicas generan una dificultad que los distingue: el ejercicio efectivo de los derechos sobre ellos depende del acceso y control de claves privadas y otros mecanismos de seguridad. La presente tesina analiza las herramientas previstas por el ordenamiento jurídico argentino que pueden ser utilizadas para la planificación sucesoria de criptoactivos, considerando sus alcances y limitaciones frente a las particularidades técnicas de estos bienes.

The incorporation of cryptoassets into individuals’ estates poses new challenges for Succession Law, particularly with regard to their transfer upon death. Although these assets may form part of the hereditary estate, their particular technological characteristics give rise to a distinctive difficulty: the effective exercise of rights over them depends on access to and control of private keys and other security mechanisms. This thesis analyzes the legal tools provided by the Argentina legal system that may be used for the estate planning of cryptoassets, considering their scope and limitations in light of the technical characteristics of these assets.
